Text entrants must have a text messaging two-way capable handset and digital service in order to enter. Entrants will be charged by their wireless service providers for text messages sent and received from an entrant's handset according to the terms of entrant's wireless service plan. Sponsor will not add any additional charge for entries by Text Messaging. Sweepstakes Entities will not be responsible for unavailability of phone lines or connections, wireless service, or any other technical malfunctions that may interfere with an entrant's attempt to enter by Text Messaging. WINNER SELECTION AND NOTIFICATION: On or about January 7, 2009, five Sweepstakes Winners (one from each Local Viewing Area Entry pool) will be selected at random from among all entries received in that Local Viewing Area Entry pool and tentatively declared winners subject to eligibility confirmation and compliance with these rules. Each of the five Sweepstakes Winners will receive one Sweepstakes Prize. One Sweepstakes Prize Winner will be selected at random from among the Five Sweepstakes Prize Winners and tentatively declared the Grand Prize Winner (subject to eligibility confirmation and compliance with these rules). Odds of winning a Sweepstakes Prize are based on the number of eligible entries received. The odds of a Sweepstakes Winner being selected as the Grand Prize Winner are 1 out of 5. If an entrant selected for a Grand Prize is determined to be ineligible, cannot be reached by reasonable means within a reasonable amount of time after the random drawing, or otherwise fails to comply with these Official Rules, that entrant shall be disqualified, and another entry will be selected at random from the remaining eligible entries until an eligible winner is selected. Final decisions regarding substitute Sweepstakes and Grand Prize Winners will be made and are at the sole discretion of Tribune Broadcasting. 6. SWEEPSTAKES PRIZES:
Grand Prize travel and arrangements are subject to availability, holiday, blackout dates and other restrictions. Hotel accommodations will be based on availability at time of booking and travel. Trip must commence on either February 5, 2009 (with return on February 9, 2009) or February 6, 2009 (with return on February 10, 2009). The Grand Prize is non-transferable. If the Grand Prize Winner in unable to use the prize, prize shall be forfeited and no alternate Grand Prize will be awarded, nor will an alternate Grand Prize Winner will be selected. Sweepstakes Winners and The Grand Prize Winner must be 18 years of age or older at the time of the prize trip. If the Grand Prize Winner's travel companion is under 18 years of age, the Grand Prize Winner must be the parent or guardian of his/her companion. Prize trip includes only the elements specified in these Official Rules. Grand Prize Winner and his/her guest shall be responsible for all other expenses that may be incurred during the prize trip, including but not limited to local transportation, meals, entertainment, sightseeing, room service, and gratuities. Estimated Retail Value (based on available airfare as of 10/6/08) = $3,596 - $4,036 (depending on departure city). In the event that available fares increase at time of booking, the maximum retail value of the Grand Prize will be $4,159. The ARV may vary based on travel dates and times. The difference between the stated ARV and the actual value of the prize will not be awarded. Prize Winners may be required to claim prizes at the closest participating Tribune Broadcasting television station on a weekday during regular business hours, 9:00 am to 5:00 pm. If a winner fails to claim a prize within 5 days of notification or by such other time as required by Sponsor, prize shall be forfeited. No substitutions will be made on any prize except at the discretion of the Sponsor, which may substitute a prize of greater or comparable value. Federal, state and local taxes, and any fees associated with winning are the sole responsibility of each prize winner, who each will receive a 1099 tax form reflecting the actual value of any prize valued $600 or more. Winners may be required to fill out and submit a completed W9 form (available at http://www.irs.gov/pub/irs-pdf/fw9.pdf) prior to receiving a prize. 7. ELIGIBILITY RESTRICTIONS. The Sweepstakes is open to legal U.S. citizens ages eighteen (18) and over at time of entry, residing in the viewing areas of WPIX, KSWB, WGNO, WXIN or KDAF. Employees, officers and director of Sponsor, Vibes Media LLC, the NFL Entities (as defined below), the Participating Stations and any other entity involved in the creation, promotion or administration of the Sweepstakes, and each of their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, franchisees, licensees, advertising, promotion and public relations agencies (all of the foregoing collectively referred to as the "Sweepstakes Entities"), and any relatives of, and those living in the same household, or any such employees, officers or directors shall not be eligible to participate in the Sweepstakes or win the Grand Prize. For purposes of this Sweepstakes, relatives are defined as mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren. 10. INTERNET: If for any reason, the Internet-related portion of this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Sweepstakes, the Sponsor reserves the right, in its sole discretion, to terminate or suspend the Sweepstakes or any portion of the Sweepstakes. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions. |
